Welcome to The Men Spirit. By engaging in our programs and services, you agree to the following terms and conditions. These terms are designed to ensure clarity in our services, protect your privacy, and outline responsibilities. 1. Nature of Services
The Men Spirit offers holistic therapy services, including mindset coaching and Root Cause Therapy, which are not a substitute for professional medical, psychological, or psychiatric advice, examination, diagnosis, or treatment. It is your responsibility to seek medical advice for any health-related concerns.
2. Privacy and Confidentiality
Data Storage and Security
All personal and clinical data is securely stored using Carepatron, a platform that complies with Australian data protection laws. Client information, including health history, personal details, and session notes, is kept confidential and will be stored for a minimum of 7 years.
Online Sessions
Therapy sessions conducted online through Carepatron are encrypted to ensure your privacy and confidentiality. By agreeing to participate in online therapy, you acknowledge that while every effort is made to maintain a secure environment, there is always a minimal risk of data breaches due to the nature of internet communications. We recommend that you use a private and secure internet connection for online sessions.
Confidentiality Agreement
All your information remains confidential unless written consent is provided or disclosure is required by law (e.g., legal subpoena or threats to life).
Newsletter and Marketing
Clients may opt-in to receive newsletters and promotional content. Your personal contact details for these purposes will only be used with your consent, in compliance with anti-spam laws.
Right to Data Deletion
Clients have the right to request data deletion. However, any request will require legal reasoning and a follow-up process to ensure compliance with Australian laws and regulations.
3. Client Responsibilities
By undertaking these therapy services, you agree to:
- Provide Accurate Information**: You are responsible for disclosing all relevant medical conditions, mental health concerns, injuries, or presenting issues that could affect treatment. Failure to do so releases the therapist from liability.
- Health Changes**: You agree to inform your therapist of any changes in your health or circumstances that may impact your treatment.
- Emergency Medical and Mental Health Support: The services provided by The Men Spirit are not a replacement for emergency medical or mental health support. In any urgent situation, you must contact emergency services, your GP, or your local mental health hotline immediately.
4. Cancellation Policy
Sessions canceled without 24 hours' notice will be forfeited, and no refund will be provided. Emergencies will be considered on a case-by-case basis. Once sessions commence, no refunds will be offered.
5. Liability Waiver
You acknowledge and agree that by participating in these services, you accept full responsibility for the outcomes and risks involved.
Waiver of Liability
The Men Spirit and its therapists are not responsible for any injuries, damages, or losses resulting from the services provided, as long as they are competently delivered. By participating, you waive and release The Men Spirit from any liability, both now and in the future, relating to these services.
6. Safety for Face-to-Face Visits
Home Visits
If therapy sessions are conducted at a client’s home, both the therapist and the client are expected to maintain a safe and respectful environment. Clients are responsible for ensuring that the location is free from any risks or hazards. The therapist reserves the right to refuse or cancel a home visit if the environment is deemed unsafe.
Health and Safety Measures
Both the client and therapist should follow any relevant health and safety guidelines, including those related to COVID-19 or other public health requirements. The therapist may request that sessions be conducted online if any health concerns arise.
7. Emergency Procedures
The Men Spirit adheres to a standard emergency response for medical and mental health situations. In case of a medical emergency, you should immediately contact your local emergency services or GP. For mental health emergencies, you should reach out to a mental health hotline or professional immediately. These services are not provided by The Men Spirit, and it is essential that clients use these resources in urgent situations.
8. IICT Compliance
The Men Spirit operates under the guidelines set by the **International Institute for Complementary Therapists (IICT)**. We adhere to their standards of professional conduct and care. Any disputes or complaints will be managed in accordance with IICT guidelines.
